Limited, and we have now been required by the Japanese Patent

Office to associate the two marke, a procedure which is similar

to that in the United Kingdom, and which has the effect of

precluding the sale of the one trade mark so associated, and

the goodwill attaching thereto, without at the same time

conveying the other mark or marke so associated, and the

goodwill attaching to them.

On the 13th. November 1911, we forwarded to you a

copy of the letter of the 21st. October 1911, received by

British Cigarette Company, Limited from that Company's

Trade Mark Agent in Tokio,

You were good enough to communicate with His Majesty's

Ambassador at Tokio sending him instructions to enquire

of the Japanese Government, the reasons which caused the

Japanese Patent Bureau to refuse to register marks of British

Cigarette Company, Limited.

In your letter to us of the 18th. March 1912, you stated

that the Japanese Government, in reply to Sir C. Macdonald,

nade no reference to the inapplicability of the Japanese

Trade Marks law to British Companies domiciled or

registered in Hongkong.

It is preferable to register in Japan, marks of

British Cigarette Company, Limited, Hongkong, in the

name of the owner, and not in the name of this Company.

We shall be glad if you will kindly take up the

matter with the Japanese Government in order that British

Cigarette Company, Limited may be allowed to register

their marks in Jepan in their own nane,

We are &C.,

(British American Tobacco Company, Limited)

(Signed) Joseph Hood.

Director.
